New setback for UEFA and FIFA in their dispute against the Super League. The Commercial Court number 17 of Madrid has partially upheld the lawsuit filed by the European Super League Company SL (ESLC) in the fight it maintains against the organizations chaired by Aleksander Ceferin and Gianni Infantino.
The ruling accuses both UEFA and FIFA of abuse of a dominant position and of impeding free competition in the market “by considering that they violate articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU) and attributing the discretionary power to prohibit participation in alternative competitions and impose unjustified and disproportionate restrictions”, as reported this Monday by the Superior Court of Justice of Madrid.

The ruling also orders both organizations to “cease the sanctioned anti-competitive conduct and prohibit its future repetition, in addition to ordering them to immediately remove all the effects of the anti-competitive actions that have occurred before or during the duration of this procedure, which “It began on April 18, 2021 when ESLC announced the launch of a new professional football competition project, called Super League, and carried out anti-trust actions in response to the response of the aforementioned institutions.”
“There is no possibility of imposing a prohibition or restriction in the abstract; that is, imposing a future prohibition on any other project or modification of the one already presented. To admit otherwise would mean accepting a kind of protection or shielding of any football competition project that was presented. by the plaintiffs which is not acceptable,” says the ruling.
This ruling follows the same line as the ruling issued by the Court of Justice of the European Union last December.
However, this resolution is not final and an appeal is possible before Section 28 of the Provincial Court of Madrid.
