House bench leaders want a replacement for the rapporteur’s amendments, overturned by the STF (Federal Supreme Court), in exchange for the approval of the PEC (proposed amendment to the Constitution) that allows the elected president, Luiz Inacio Lula da Silva (PT), breach the spending ceiling in 2023 to fulfill campaign promises. The text is on the agenda of the House this Tuesday (Dec.20, 2022), but there are uncertainties about the vote.
The deputies want to discuss a proposal to compensate for the loss of power over the Budget directly with the future Minister of Finance, Fernando Haddad (PT). They will have a meeting with him at the official residence of the President of the Chamber, Arthur Lira (PP-AL), at 10 am.
For Haddad, it will be a test of his ability to unlock the PEC. There is no consensus among deputies on the amount of the license to spend and its duration. The version approved by the Senate annually releases more than R$ 200 billion from the ceiling in 2023 and 2024.
In recent days, leaders in the Chamber have said that the majority tendency on the benches is to reduce the term to 1 year and the value, to something around R$ 100 billion.
The decision of the STF which, by 6 votes to 5, declared the rapporteur’s amendments unconstitutional, further contaminated the climate in the Chamber on the eve of the vote.
Deputies spent Monday (Dec. 19, 2022) scolding in WhatsApp groups. There were ideas such as appointing more ministers to the Supreme Court and imposing a mandate on the members of the Court. It is unlikely that such a radical measure will be taken, but the environment with the overthrow of the rapporteur’s amendments became very heavy.
haddad stated told journalists on Monday (Dec.19) that the resources for the rapporteur’s amendments will remain in the Budget and will be allocated by congressmen.
The general rapporteur of the 2023 Budget, senator Marcelo Castro (MDB-PI), said early Monday afternoon that it would prioritize commission amendments by reallocating the R$19.4 billion reserved for rapporteur amendments.
As shown the Power360the President of the Senate, Rodrigo Pacheco (PSD-MG), prepared a proposal to direct half of the resources that would be from rapporteur amendments to impositive individual amendments. The idea is to include this device in the PEC.
The measure will be presented to Haddad at the meeting. In practice, the proposal would increase the resources available to Congress in relation to 2022. The reason is that rapporteur amendments are not impositive and, therefore, may have payment blocked by the government.
