In the Lower House, the proposal still needs to be analyzed by the Constitution and Justice Commission
The Chamber’s Finance and Taxation Committee approved a bill that establishes that the construction, expansion or renovation of prisons must comply with requirements defined by the CNPCP (National Council for Criminal and Penitentiary Policy).
The CNPCP evaluates and monitors the condition of prisons and establishes rules on the architecture and construction of penal establishments and sheltered houses.
Among the minimum requirements is the division by security level (separation of those convicted of crimes considered less serious from those serving sentences for more serious crimes). The council also requires health conditions, such as minimum space for cells, ventilation and lighting, among other aspects.
The guidelines are based on international standards and, currently, only the construction of penitentiaries with resources from the National Penitentiary Fund must follow this standard. The project extends this obligation to all new prison projects in the country.
The rapporteur on the committee, deputy Laura Carneiro (PSD-RJ), recommended the approval of the same version of the text (substitute to PL 6014 of 2019from the Senate) previously approved by the Public Security and Combating Organized Crime Commission.
The substitute only adapted the original text to changes in legislation. Thus, the proposal began to change the new Bidding Lawand no longer the Law 12,462 of 2011which had part of its articles revoked.
For Laura Carneiro, ensuring compliance with minimum construction standards, in addition to affecting the conditions of incarceration and the resocialization of prisoners, also has an impact on the safety of penal officers.
“In addition, standardization can contribute to efficiency in the application of public resources, reducing the risks of building inadequate structures that will need to be redone.”
The rapporteur also noted that there is no financial or budgetary implication of the matter.
Processing
The proposal is being processed in conclusive character and will still be analyzed by the Constitution, Justice and Citizenship Commission.
