Just before they bought their ‘new’ used car, the Hyundai i20 belonging to a Nijmegen couple was still a wreck. The refurbished car was even a total loss. That was what the owners were told last year when they called the previous owner after the engine broke down on the highway.
The car salesman had not mentioned that when they bought the car from his shop four months earlier. Due to error, he was therefore sentenced this Friday to repay the purchase amount of 8,500 euros. ,,I was very shocked, it was terrible’, said the owner recently about the sudden failure of the engine.
Irresponsible to take it on the road
It is already the second time in two years that the Osse trader has been convicted by the subdistrict court in Den Bosch for the sale of a car that has been declared a total loss in Germany. In the first case, the car was even technically a total loss and then it is not responsible to take it on the road. But the trader says in both cases that he was not aware of this. He therefore appealed against the first conviction. That has yet to serve.
Dealer must look up damage history
In Germany, however, it is neatly registered whether and where a car has been damaged. The judge blames him for the fact that the trader did not look that up and only looked in the maintenance book and the valuation report. A professional dealer is required to be aware of the current condition and damage history of a car.
Because there has been a shortage of used cars in the Netherlands for years, they are bought on a large scale from abroad, especially from Germany. Last year, for example, about 130,000. The buyers from Nijmegen had also demanded that the trader had to repay the costs of 1,843 euros as a result of the engine failure. But that was rejected by the judge.
