Legal advice
a question
A question was received from a reader who said:
My ex-husband is not obligated to pay the rent alimony, despite obtaining a court ruling, so I filed a lawsuit before a court in another emirate, to implement it, but he is currently trying with his lawyer to take measures to stop the implementation.. Does he have the right to do that?
The answer
Legal advisor Dr. Youssef Al Sharif answers:
Usually, the delegation is due to the presence of funds for the person against whom the execution is being carried out in the jurisdiction of the court being delegated, and therefore the procedures before it are within the limits of the delegation. Therefore, the requests to stop the execution that are submitted to the Sharjah Court to stop the procedures at the court being delegated (Dubai) do not stop the execution unless the person against whom the execution is being carried out pays or makes a settlement. Accordingly, he submits a request to stop the execution. We believe that the requests submitted to the Sharjah Court are to cancel the delegation and not to stop the execution.
