Apparently, according to the US government, the well-known hacker Gary Bowser – which, together with the known Xecuter teamdistributed hardware and software that allowed people to run pirated games on their consoles Nintendo Switch – he should serve five years in prison. The proposed ruling is found in court documents relating to Bowser’s ongoing case and the U.S. government argues, in particular:
A 60-month sentence would reflect the nature and circumstances of the offense, the history and characteristics of the accused and the need for the sentence to reflect the seriousness of the offense, promote compliance with the law and provide for just punishment to allow for an adequate deterrent to criminal conduct.
Also, the US government suggested that Bowser should be placed under close supervision for three years after his release. According to Bowser’s legal team, what the government claims and requests is deemed particularly unfair, given Bowser’s degree of involvement in the affair.
Bowser’s lawyers claim the man was the member “Less guilty” of the hacker team and underline how the atria involved in the acts against Nintendo have not been brought to justice and that, precisely for this reason, we are raging against the only man captured. Specifically, the legal team believes that a shorter prison sentence would be more suitable:
This is undoubtedly a serious crime in which Nintendo suffered a substantial monetary loss. A 19-month sentence for the least guilty of the three defendants, in the circumstances in which Mr. Bowser actually served that sentence, is deemed more than fair.
Bowser’s lawyers also questioned the amount of money that appears to have been obtained through the activities of Team Xecuter. In fact, Bowser is estimated to have raised $ 320,000 in seven years, also claiming that other members of the piracy group would have made a lot more money. Indeed, it was precisely the enormous flow of money that came to Xecuter team which would prompt the US government to intervene and act.
