Genoa – The Council of State rehabilitate the anti-mafia interdiction on the Research consortium who is responsible for the implementation of the spillway of the Bisagno stream in Genoa. The construction site, therefore, risks a new stopafter the first disqualification, later canceled by the Salerno TAR.
“The situation is singular: that consortium has been considered mafia or non-mafia by various courts in alternating directions – comments the president of the Liguria Region, Giovanni Toti, government commissioner of the work – We have already stopped and reopened that construction site twice. Furthermore, with a complaint against the undersigned as commissioner who closed the construction site at the first prohibition, he handed it back when it was cancelled. And now there's a new one.”
Toti makes it known that he has already “summoned the State Attorney's Office to know how we should behave. Furthermore, a rehabilitation judgment is pending at the Campania Court for that consortium and is already scheduled for March 27th. We have a need to protect legality, but we also have a need not to have a construction site which like trains makes a stop every quarter of an hour depending on the court that rules. We will ask if it is necessary to terminate the contract again or if it is necessary to wait for the new judicial ruling to have a definitive word or to find out what other measures the commissioner structure must take”.
The position taken by the Deputy Minister of Infrastructure and Transport is also clear, Edoardo Rixi. “I am certainly not a fan of this consortium, I believed that other decisions should have been made at the beginning – he states – but the Courts need to coordinate: one cannot think that depending on the court, there will be different interdictions. On works like those , when there are public tenders, the protection of the citizen and the realization of the work must be guaranteed. This is why today we carry out all the anti-mafia protocols in advance of the opening of the construction sites.”
The government representative asks that “they tell us what we must do, but the laws must be the same and there must be a univocal interpretation. It is clear that Genoa and Italy in general cannot go behind Byzantine situations of this type. That we would have already finished the spillway: we cannot think of proceeding in this way with public works. Let's make a decision and give the government powers to proceed without getting into disputes with the private sector again. There are institutions that do not yet realize the needs of the country: certainly there is legality but also the creation of works that guarantee the safety of citizens. We have a particularly byzantine justice system: if we take the work away from the consortium we will end up in Court and it doesn't mean that they agree with us; If we keep the consortium, we risk having the work blocked.”
