Balneari, the EU applauds: “We welcome the government’s decision”
“The Commission welcomes today’s decision by Italy on the beach concessions case. This follows constructive exchanges through which the Commission and the Italian authorities have reached a common understanding on the legislative framework for the reform of Italian beach concessions in the light of EU law, with a comprehensive, open and non-discriminatory solution covering all concessions to be implemented within the next three years”, explained a spokesperson for the EU Commission.
“At this stage, the Commission has not taken any formal decision in the infringement procedure. The Commission will assess the legislative decree adopted by the Italian authorities in the light of the common understanding”, explains the spokesperson for Palazzo Berlymont, who adds: “the Commission will remain in close contact with the Italian authorities regarding the implementing measures and the effective completion of the tendering process and renewal of all existing concessions, within the agreed timeframes”.

With reference to “the infringement procedure on beach concessions, the collaboration between Rome and Brussels has made it possible to find a balance between the need to open the concessions market and the opportunity to protect the legitimate expectations of current concessionaires, allowing us to conclude a long-standing and complex issue of particular importance for our nation”. This is stated in a note from Palazzo Chigi after the green light from the Council of Ministers to the reform of beach concessions within the framework of a decree law that “will facilitate the closure of 16 infringement cases and one EU Pilot case”.

THE main points of the reform of beach concessions are the extension of the validity of the current concessions until September 2027, the obligation to start the tenders by June 2027, the duration of the new concessions from a minimum of 5 to a maximum of 20 years, in order to guarantee the concessionaire to amortize the investments made. This was announced by Palazzo Chigi in a note. There is also the obligation to hire workers employed in the previous concession, who received from that activity the main source of income for themselves and their family unit, the compensation for the outgoing concessionaire paid by the incoming concessionaire and equal to the value of the depreciable and not yet depreciated assets and the fair remuneration of the investments made in the last five years. Among the criteria for evaluating the offers, having been the holder, in the previous five years, of a beach concession as the main source of income for themselves and their family unit will also be considered
Meloni-Salvini-Tajani summit on seaside resorts before the Council of Ministers
The issue of the reform of beach concessions, as far as we know, is at the center of a summit between Prime Minister Giorgia Meloni and the two Deputy Prime Ministers, Antonio Tajani and Matteo Salvini, before the Council of Ministers that was scheduled for 5:30 p.m. and should begin shortly. We are waiting to see whether the Council of Ministers will examine the decree with the new rules on beach concessions, which has been the subject of a discussion between the government and the European Commission in the last few hours.
Beach resorts: draft decree, extension until September 2027
Beach concessions are extended until September 2027 but in case of objective reasons that prevent the completion of the tender procedure may be further postponed to March 31, 2028. Basically, it will be discussed again in the next legislature. This is what is foreseen in the draft decree containing “Urgent provisions regarding maritime, lake and river state concessions for tourism-recreational and sports purposes” that will be examined by the Council of Ministers today.
Draft decree for bathing establishments, compensation to be paid by the new concessionaire
As can still be read in the draft decree, in the case of a new dealer, the outgoing dealer will have “the right to compensation paid by the incoming dealer”. The compensation is “equal to the value of the investments made and not yet amortized at the end of the concession, including investments made as a result of calamitous events duly declared by the competent authorities or as a result of subsequent legal obligations, net” of public aid or subsidies, and “equal to what is necessary to guarantee the outgoing concessionaire a fair return on investments made in the last five years”. This amount, it should be noted, will be established on the basis of the criteria set out in the decree of the Ministry of Transport, in agreement with the Ministry of Economy and Finance, to be adopted by 31 March 2025.
Beach Resorts: Codacons, Extension to 2027 Is Being Taken for a Ride
The extension of the beach concessions to 2027, with the possibility of extension to March 2028, represents a joke and does not resolve the issue of the Balneari in any way. Beach Resorts: M5s, three-year extension would be final farce
“With regard to the government’s work on the Balneari, the first rumours are surreal to say the least. A three-year extension for the current concessions, already declared illegitimate by the Council of State, would really be the final farce of the Meloni government, after two years of total immobility. A resounding raspberry to the EUwhich for years has been calling for the sector to be opened to competition. What the centre-right forces unfortunately do not understand is that in this way the sector will be condemned to chronic paralysis for another three years, also because the current concessionaires will have no interest in making investments and improving the sector.
