Actor Alec Baldwin is among up to four people who may face charges in October in the shooting that killed cinematographer Helena Hutchins while filming last year’s movie “Rust,” New Mexico prosecutor Mary Carmack-Altois said.
Carmack-Altois added, in a letter to the state’s Department of Finance, that a final police report on the incident near Santa Fe is expected next month, stressing that at that time prosecutors will file criminal charges if necessary.
She said investigators were focusing on “several individuals” who handled the pistol Baldwin fired during rehearsal for a scene in the film, killing Hutchins and wounding director Joel Sousa.
“One of the potential defendants is well-known film actor Alec Baldwin,” Carmack-Altois said in a letter dated August 30 requesting additional funding for this trial.
The chief prosecutor told the department during a September 20 meeting that there will likely be four jury trials with each defendant due to the potential for some divergence in the state’s homicide laws.
Baldwin has denied responsibility for Hutchins’ death, and said that live ammunition should never have been allowed on the set.
His attorney, Luke Nikas, cautioned against assumptions that Baldwin would be indicted.
“The prosecutor has made it clear that she has not received the police chief’s report or made any decisions about who, if anyone, will be charged in this case,” he said in a statement.
