The Anticorruption Prosecutor’s Office will take over the investigation opened by the Court of Instruction number 13 of Seville on the emergency contracts of the Andalusian Health Service, encrypted in (SAS) after the complaint presented by the PSOE-A and encrypted in close to 300 million.
Judicial and Public Ministry sources have confirmed to ABC that it will be the Anti-Corruption Prosecutor’s Office that will carry out the investigation against the Government of the Junta de Andalucía for alleged embezzlement and prevarication in the allocation of these emergency contracts through the exceptional procedure approved for the pandemic Covid-19 and which, according to the socialists, the SAS continued to use until 2023, “two years after its legal repeal.”
From the Superior Court of Justice of Andalusia (TSJA) the PSOE-A, has explained that this party has already appeared as a popular accusation after having paid the bail payment required by the court.
In the order of preliminary proceedings, which were initiated for an alleged crime of administrative prevarication, without prejudice to what may be determined during the investigation phase of the case, the judge requested documentation from the General Intervention of the Junta de Andalucía, the Central Intervention of the Andalusian Service and the Court of Accounts, documentation that is already being received by the judicial body.
The PSOE asks Juanma Moreno for explanations
The coordinator of the Presidency of the Socialist Parliamentary Group, Rafael Márquez, asks for “explanations” from the president of the Junta de Andalucía, Juanma Moreno, for the “enormously serious” case of “massive irregular diversion of hundreds of millions of euros from public to private healthcare” through contracts of the Andalusian Health Service (SAS).
«That the Anti-Corruption Prosecutor’s Office has taken on the case highlights the seriousness of the events that we have been denouncing from the PSOE of Andalusia, a ‘modus operandi’ of massive irregular diversion of hundreds of millions of euros from public to private healthcare,” he maintained.
The socialist representative has added that Juanma Moreno «it’s already late to give the explanations” that the PSOE-A demands of him, from where they also demand “transparency and assumption of responsibilities in a case that we understand to be extremely serious,” as Rafael Márquez concluded by stating.
The spokesperson for the Socialist Group, Ángeles Férriz, has also spoken on this matter in a note on her account on the social network ‘X’ in which she stated that “the explanations that the PP has not given to the Andalusians for destroying their public health and put your health and life at risk, “They are going to give them in court.”
Court of Instruction number 13 of Seville admitted for processing on June 20 the complaint presented by the PSOE-Awhich took these contracts to court by maintaining that the Junta Government used an emergency procedure «without advertising, nor control, nor attendance and based on repealed regulations.
The general secretary of the PSOE-A, Juan Espadas, then assessed the admission for processing of this complaint “due to abuse in emergency contracting by the Ministry of Health for two years since the end of the pandemic through finger awards, “non-competitive awards of public resources to private healthcare.”
The Minister of Health and Consumer Affairs of the Government of Andalusia, Rocío Hernández, then again denied that a “fraud of law” occurred in said contracts: “It is flatly false that fraud has occurred in the contracts. The actions and contracts carried out by the SAS have complied with the law at all times.
He stated that the SAS “has always worked with legal reports for the development of the emergency contracting modality, while the health alert and the need to provide assistance to citizens required it,” and “transparency” has been guaranteed by the Andalusian administration, because “both the resolutions of the contracting body and the contracts and addendums have been gradually published” on the Board’s Transparency Portal, “with public access and without any restrictions.”
