Agnelli legacy, John Elkann in the corner: he will have to say what he knows in the civil case
The civil case brought by Margherita Agnelli for issues revolving around the inheritance of her father, Gianni Agnelli, resumes in Turin. The proceedings were suspended by the subalpine court in June last year with an order partially annulled by the Supreme Court. Margherita’s legal initiative concerns her children John, Lapo and Ginevra Elkann. Judge Nicoletta Aloj, dissolving the reservation, announced the reopening of the case, ordering Margherita’s counterpart to produce a series of documents and ordering the hearing of some people as witnesses: among these was John Elkann. The case was adjourned until December 2.
The judge established that before bringing the case back to the panel it is necessary to start an investigation into some of the chapters of evidence put forward by both parties. Hence the decision to acquire documents and testimonies (about twenty in total based on a first reading of the ordinance).
The judge also ordered the three Elkann brothers, and the Swiss notary Von Grunigen the exhibition of all banking documentation referring to the “relationships maintained by Marella Caracciolo during her lifetime with banking institutions (abroad) with whom he had established existing relationships”. And also of “all the documentation referring to the inventory operations carried out on the occasion of and subsequent to the opening of the Caracciolo Succession” or of Donna Marella Agnelli.
However, the same judge did not admit “the orders for the production of documents requested with reference to December” the safe company of the Agnelli billionaire holding. And not even the presentation requested by Margherita, assisted by the lawyer Dario Trevisan, with respect to “any management report” of the will, the correspondence maintained with John, Lapo, Ginevra Elkann and “all the documentation relating to the Unfound Works and the Additional Assets not found constituting the subject of the requests made in relation to the Agnelli Succession”.
