Former Minister José Luis Ábalos has in his possession, and will foreseeably contribute it to the Koldo casetwo bank transfers, of 5,000 and 2,500 euros, ordered in July 2021 from his personal account and destined for the company Have Got Time SL, the company that owns the chalet that he would have rented that summer and that is the subject of investigation as the Prosecutor’s Office considers that it could have been a gift.
Both transfers indicate that the beneficiary was Have Got Timewhich were carried out on July 5 and 6, 2021 and that the ordering party was José Luis Ábalos himself.
Sources from the environment José Luis Ábalos have explained that the first transfer, of 5,000 euros, was as a deposit for the rental of the chalet located in the urbanization of La Alcaidesawhile the second of 2,500 euros already reflected that the concept was July rental of the Alcaidesa.
It is worth remembering that, according to the report of the Central Operational Unit (UCO) of the Civil Guard, that chalet could have been a gift towards the former minister and that, although it was supposedly used by Ábalos, it was largely paid for by the company Have Got Time.
The agents added that this company was “really controlled” by the businessman. Claudio Rivasthe partner Víctor de Aldama—achiever of the alleged plot—.
The burofax
The UCO report also stated that a few months after Ábalos left the Ministry of Transportation, that company—Have Got Time—sent a burofax to the former minister in which it demanded payment of four monthly payments for the chalet.
That burofax, dated October 12, 2021, detailed that since the minister had not paid for the months of August, September, October and November 2021, they invited him to catch up on the pending monthly payments.
To this, the document added that if he preferred not to continue renting the property, they offered to terminate the contract and forgive him the outstanding debt if he returned possession of the home within 20 days.
Sources close to the former minister explain that after renting the chalet, several events occurred, both Ábalos’ departure from the Ministry and other personal matters, which led him to lose interest in the rental and he decided to leave it.
They also explain that given that the former minister had contributed three monthly payments in total, the debt for October and November 2021 was actually forgiven.
Treasury requirements
On the other hand, Europa Press has had access to two proceedings from the Tax Agency that, both in 2022 and 2023, were addressed to the former minister to request that in the event that he had any pending payment with the company Have Got Time, he would make it directly to the treasury, given that that company owed more than 65.5 million.
In one of them, from February 2023, the Treasury informed Ábalos that that company had outstanding debts and that since they knew that it had a “commercial relationship” with it, they informed it of the seizure of any credits it had pending payment.
Ábalos answered both the first requirement of 2022 and that of 2023 and in both cases he stressed that “his relationship with the obligated company (…) referred to the rental of a house in the La Alcaidesa Playa urbanization, in The Line of Conception for the summer with a contract date of July 1, 2021 and which was resolved (…) in October 2021″.
In the observations of his response, the former minister added that since he no longer had “any relationship with said company or debts with it”, he asked to be freed from the “file definitively.”
In fact, the former minister in the 2022 response provided both bank transfer receipts as payment for the rental of that chalet and stressed that both parties terminated the contract “for various reasons, such as my disagreement with the state of the property and other personal reasons that led me to terminate the lease.”
The sources consulted explain that since the last response, which dates back to 2023, the former minister has not received any other communication in this regard from the Treasury, so they understand that the file has been closed.
It is worth remembering that in the last report of the UCO The former minister was attributed a “relevant” and “responsible” role in the alleged plot that would have kept commissions in the public awarding of contracts for the purchase of masks in the pandemic.
The agents stressed that “the logical enumeration of evidence exposed up to this point offers an approach to the facts in which Ábalos acquires a relevant and responsible role in his direct relationship with Koldo.” [García, su exasesor], [Víctor de] Aldama and the criminal organization energized by the latter”.
