Aragón takes action. The Aragonese Government and the public company Aragón Plataforma Logística (APL) have presented today, the last day of the deadline, cassation appeals before the Supreme Court against the sentence on October 10 of the Administrative Litigation Chamber of the Superior Court of Justice of Aragon (TSJA), which declared the nullity of the collaboration agreement between the Autonomous Executive, APL and the company CIPSA Norte, which was signed on February 2, 2022. In addition, the ruling also annulled the Project of General Interest (PIGA) for the development of the PlaZa 4.0 logistics platform At the Lidl company I wanted to launch a logistics hub.
Both the Government of Aragon and APL state in their resources that it is in accordance with right to use public-private collaboration formulas as is the case of collaboration agreements for the development of projects of general interest of private initiative, without the general public contracting regime being applicable.
Furthermore, the two resources also point to the possibility of allow a private developer to own the majority of the landas happens in this PlaZa 4.0 operation, as well as the promotion, writing and execution of a private initiative project classified as being of regional interest.
Likewise, this possibility is pointed out for the instrumentalization of the relationship with the Administration through the aforementioned public-private collaboration techniques.
Despite these premises indicated in both resources, the Government of Aragon has indicated that the evolution of the project will be reconsidered according to the interest of the indicated companies regarding the expected resolution deadlines and other issues that are of relevant public interest.
The ruling that is now being appealed refers to the expansion of the Zaragoza Logistics Platform for which a reclassification of 242 hectares in front of the La Peñada golf course.
As indicated in the TSJA ruling, some “vices” of legality and “surprising” privileges granted to the company were observed. Reference was also made to the appeals presented by individuals who appealed against the project when they were not informed of the expropriation of the land or the plans planned by the company.
The company Lidl formalized a purchase option last year for a future plot in PlaZa 4.0 for the installation of its macro logistics center to provide service to southern Europe, together with the logistics center that already exists in Barcelona. The investment was estimated at that time in 100 million of euros, with a generation of 200 jobs.
