The European Court of Human Rights (ECtHR) will rule this Tuesday on whether the age limit set to appear at the Ertzaintza is discriminatory, as announced by the Strasbourg-based court.
The magistrates deliberate on the lawsuit filed by an individual who defends that the fact that an age limit – 35 years – is set to apply for a public competition for positions in the Basque Country Police Corps on the basic scale it is “discriminatory”.
The man insists that, “despite having passed the physical and medical tests to access the position”was “rejected because of his age.” In this case, the ECtHR has asked the parties if they consider that the plaintiff was “victim of differential treatment due to age”which would imply a violation of article 1 of Protocol 12.
If the answer is affirmative, the magistrates ask if said difference in treatment pursued a “legitimate objective” and had a “reasonable justification.”
The ECtHR has reported that it is expected that the conclusion reached by the judges be made public the same Tuesday.
