The Government approved this Tuesday in the Council of Ministers a reform of the regulations of the immigration law with which aims to regularize 900,000 migrants in the next three years at a rate of 300,000 each year. The regulatory change promoted by the Executive will also extend the duration of job search visas, create two new forms of residence authorization based on roots and relax the requirements for the reunification of families of migrants with Spanish nationality.
This is the fourth reform of this regulation that the Government has undertaken since 2018. The previous three focused on students, accompanied minors and the creation of the figure of roots. Now, the Executive is launching a new modification that puts the focus once again on the incorporation of people in an irregular situation into employment. In the words of the Minister in charge of Migration, Elma Saiz, this is the “most comprehensive and ambitious” reform that has been carried out since this regulation was created in 2011.
First of all, The Government has renewed the residence visa system and has given it a specific section within the standard. All visas now have a standard duration of one year and renewals will be for four. Regarding the job search modality, those who receive the visa will be able to reside in the country while looking for an occupation for one year and not the three months that the previous regulation included.
In second place, The Executive has acted on the figure of rootswhich allows you to obtain residence permits due to exceptional circumstances. In this section, three new rooting situations are created: socio-occupational, socio-training and second chance. In addition, the length of stay that must be proven to access roots is reduced to two years in all cases and will allow the migrant to work both on a salaried and self-employed basis from the first moment.
