The Prosecutor’s Office has requested a sentence of 19 years in prison for a man of Almeria accused of subduing within the framework of the gender violence to a 15-year-old minor whom he sexually assaulted on several occasions. The accused, who was between 25 and 26 years old at the time of the events and lived with his relatives next to the minor’s home, would have maintained a relationship similar to a courtship with her for about nine months between July 2017 and March 2018 in which, according to the victim’s testimony, He exercised tight control over his actions, conversations and movements..

The victim suffered physical attacks

It was the same all the time, My relationship was based on arguing and doing what he wanted.“said the injured party, who also pointed out the physical attacks that he suffered in the course of their meetings, with “smacks” and “hair pulling”, among other humiliations.

During his statement, the accused denied when asked by the prosecutor that he pushed, spat at the victim or insulted him, since he even went as far as to assure that it was “the other way around”, since, according to his version, It would be the minor who would have tried to control him requesting photos of where he was or asking him to answer his messages immediately while he was at work.

However, he has acknowledged that there were sexual relations with the minor that, according to his story, would have been consensual, since he has detailed that if they did not use a condom it was because she “takes the morning after pill.” In any case, he has rejected that he forced the teenager to carry out practices to which the victim would have resisted.

The victim: “Not all” relationships were consensual, “He told me I had to do it and that’s it”

Faced with this, the victim has been persistent in her story to once again confirm that “not all” relationships were consensualsince sometimes she felt obliged to accede to the accused’s wishes since otherwise “they were hair-pulling”, “insults” or threats to throw her out of the house. “He told me that I had to do it and that’s it.“, he narrated.

Regarding the use of protective measures, she has emphasized that she asked him on different occasions to use a condom. “I was 15 years old, I couldn’t risk getting pregnant or getting sick, but he didn’t want to, I told myself that if not, I wouldn’t feel the same pleasure.“, she detailed before specifying that she had two pregnancies with abortionone “natural” and one in a clinic.

The defendant’s reaction was to say that “I was a slut.”

“His reaction was to tell me that it wasn’t his, that I was a slut and that it belonged to any man,” the woman explained in response to the version given by the accused, who has assured that he learned about said abortions later and that he did not arrive. never to accompany the girl to a clinic.

Although the relationship broke down after the minor entered a juvenile center, the prosecution maintains that after all these events, the accused would have gone in search of the victim, whom he would have even threatened on December 1. June 2019 after meeting on the street.

During the hearing, the mothers of the accused and the victim, as well as a multidisciplinary team from the ‘El Carmen’ educational group, made up of educators and psychologists, have testified, who have confirmed their reports on the situation in which they cared for the minor after the events. , of those who came to transfer to Andalusian Women’s Institute (IAM).

Following his statements, the Prosecutor’s Office has maintained its requests for three years in prison for an alleged crime of physical and habitual violence in the context of gender violence, 14 years in prison for a crime of sexual assault with continued penetration and another two years in prison for crimes of abuse and threatsboth in the field of sexist violence.
