Suspends the statement of the politician as investigated and of the actress and complainant Isabel Mouliaá as a witness
The complainant’s lawyer asks to suspend the deadlines of the case due to her advanced pregnancy, but does not appoint a substitute
The judge who opened an investigation into Sumar’s former spokesperson, Íñigo Errejón, for the alleged crime of sexual assault following the complaint against him by actress Elisa Mouliaá, has agreed to provisionally file the case after suspending the procedural acts and deadlines at the request of the complainant’s lawyer. Neither she will testify tomorrow as a witness nor he as an investigator, as planned.
Mouliaá’s lawyer requested to suspend the deadlines given her advanced state of pregnancy so that time does not play against the complainant in the face of a possible prescription. Judge Alfredo Carretero has agreed to suspend the deadlines and has also decided to provisionally archive the case.
Last week, the head of the Court of Instruction 47 of Madrid, Adolfo Carretero, already postponed the statements for a few days, which were scheduled for this Tuesday. Firstly, Mouliaá was summoned as a witness and an hour later, Errejón was summoned as an investigator.
In an order this Monday, the judge decided to file since the lawyer has not appointed a lawyer she trusts to replace her. “Having received today the report of temporary incapacity of the aforementioned lawyer, who has refused to appoint another lawyer to replace her with confidence, the inevitable consequence is the impossibility of continuing the procedure, due to articles 4 and 179.3 of the Criminal Procedure Law, since the law does not regulate the suspension of the procedure due to prolonged absence of a lawyer during the investigation and only article 746.4 of the Criminal Procedure Law refers to the suspension of the trial due to sudden illness of the lawyer”.
