The Criminal Chamber of the Supreme Court has agreed to take on the investigation of the actions of the former Minister of Transport José Luis Ábalos in the Koldo casefor the irregular procurement of masks and medical supplies during the pandemic, upon seeing evidence of several crimes against him.
The court appoints the instructor, according to the established shift, to the magistrate of the Chamber Leopoldo Puente.
Regarding the non-certified persons included in the proceedings instructed by Judge Moreno in the National Court, the Supreme Court indicates that the procedure must continue there and that the extension of jurisdiction to the Supreme Court will only be appropriate when an inseparable material connection with the facts investigated regarding José Luis Ábalos.
The order of the Chamber, for which Judge Andrés Martínez Arrieta has been the rapporteur, highlights that, “at this procedural moment, it is their responsibility to verify whether facts are recorded that, according to a very provisional assessment, could be criminal, and if there are consistent indications or, in other words, principles of proof of the participation of the certified person in them”.
For the Criminal Court, it is “essential” to continue the investigation into the Koldo case and about the participation in said case of the former socialist minister José Luis Ábalos.
The order explains that the appointment of an instructor in the Supreme Court for the investigation of the case is carried out, in principle, only for the “investigation of the facts for which, indirectly, the authorized person could be responsible and with respect to those people who, due to needs, of the instruction (…) the investigation is inseparable”.
