The lieutenant prosecutor of the Supreme Court, María Ángeles Sánchez Conde, has filed an appeal in the high court against the searches carried out last Wednesday in the offices of the State Attorney General, Álvaro García Ortiz, and the provincial chief prosecutor of Madrid, Pilar Rodríguez, Europa Press reports.
For more than ten hours, an agent from the Central Operational Unit (UCO) of the Civil Guard cloned the content of mobile phones and computers in the framework of the case opened against both for the alleged leak of an email related to the investigation by tax fraud against Alberto González Amador, partner of Isabel Díaz Ayuso. In parallel, the businessman’s accusation has asked that Sánchez Conde, who is the ‘number two’ of the State Attorney General’s Office, step aside from this procedure.
In his opinion, there are up to four causes of abstention in Sánchez Conde: having “intimate friendship” with any of the parties; having participated “directly or indirectly” in the matter; having “issued an opinion” on it; and “have direct or indirect interest” in the case.
Thus, it details that Sánchez Conde wrote the report on September 30 in which the Prosecutor’s Office requested that García Ortiz not be opened, that he was present in the aforementioned search or that he participated in the Board of Court Prosecutors that agreed by a majority to be asked that González Amador’s complaint be inadmissible. It also states that Sánchez Conde’s professional activity and position are “directly linked” to García Ortiz’s permanence at the head of the State Attorney General’s Office.
González Amador’s request to the Supreme Court arrives the same day that the Prosecutor’s Office has informed in an internal communication to the prosecutor’s office that García Ortiz has extended to the high court the abstention that he already agreed to for this case when he was in the Superior Court of Justice of Madrid (TSJM) and in a Madrid court.
This means that Sánchez Conde will be exempt from receiving orders from García Ortiz and from reporting to him regarding this case, thus guaranteeing the independence of the lieutenant prosecutor in decision-making in this judicial procedure.
