Fabian LealColombian electrician residing in Alfafar, one of the Valencian towns devastated by DANAdenounced this past Monday on TVE the precarious employment situation —in addition to the vital one— in which the most destructive storm in recent years has also left him.
Although this past Monday the Ministry of Labor recalled that it is illegal to fire workers who cannot access their jobs due to the effects of DANA, Fabián Leal said this Monday on TVE that his boss was forcing him to go to work. work yes or yes under the threat of dismissal.
That same day, Yolanda Diazsecond vice president of the Government and minister of Labor and Social Economy, announces the creation of a “labor shield” with retroactive effects from October 29, the day the tragedy occurred. A shield that according to Díaz was going to serve so that “neither a company nor a worker will fall”.
That shield has been of little use to Fabián Leal. As he explained before the TVE cameras, His car was destroyed by DANA and there was no public transportation either. that would allow him to travel to the workshop where he works. Not only this, but his boss urged him to find any means to get there, even suggesting that he ask his neighbors for help if necessary. The only option was to walk, but it took almost four hours.
After telling his story on TVE and faced with the “obligation” to go to work as his boss told him, Leal walked there. Fearing the boss’s reaction, the electrician recorded their meeting, which has gone viral on social media. “You had to be there at seven”the boss tells the electrician with a dismissive gesture inviting him to leave and dismissing him. Faced with this attitude, Leal turns around and leaves.
The “shield” put in place by Labor includes measures such as the Temporary Employment Regulation Files (ERTE), without a waiting period, which do not consume unemployment and with the obligation of companies to maintain employment.
This Tuesday, Labor has reported that 31 have already been requested temporary employment regulation files (ERTE) due to force majeure affecting 300 workers, in addition to another 44 who have not been detailed as affected.
As stated in a press conference by the Secretary of State for Employment, Joaquin Perez Reythese are files requested before the Generalitat Valenciana, the competent authority to verify force majeure in these cases. “It is an incipient moment to give a global vision,” added Pérez Rey, who explained that this is data that the Generalitat Valenciana transfers to them.
“No one is going to lose rights, neither salaries nor contributions,” Yolanda Díaz stated on Monday, while asking workers not to be afraid.
