Regarding this accused, he assured that a witness stated that he told him: “I couldn’t do anything because a black man stopped me.” “He is seen running after Kaio and enters the core point of the aggression and at a given moment he shoots out,” he added about the images from that day. Regarding the alleged theft of Samuel’s cell phone by Kaio – a fact for which, in addition to murder, he is charged with this crime – he explained that it was not until a second statement with his lawyer when he said that a phone was found “for there and take it.” “One of the friends mentions it,” he said about the alleged attempt to sell the phone.

Sequence of events

Also with questions from some of the defenses about whether the video images show that someone was carrying a bottle or a knife. “Witnesses report it, I didn’t see it,” he stressed after specifying, to another defense, that in a search of the home of one of the convicted minors they found a knife, without being able to specify more regarding this point.

Testimonies about the only accused

The two agents who arrived at the scene of the incident, after being notified, also gave statements at the trial. One of them confirmed that Samuel’s friend told her that a person, “a girl,” had pulled her aside to “prevent” her from helping the victim.

Previously, a witness requested by Catherine SB’s lawyer, who had known her since she was eleven years old and who lived with her for six months, has stated that she “never” showed a derogatory attitude towards her because of her sexual orientation.

In this regard, and when asked by this lawyer, he said that he also defended him when they called him a “faggot.” “It made her uncomfortable,” she added when questioned about the accused’s attitude towards such disqualifications, which, according to the accusations, she also used against the deceased. For this reason, 25 years are requested for the crime of murder with aggravated discrimination due to Samuel’s sexual orientation.

This sentence is also requested for her then partner, Diego MM – whom the accusations consider the person who initiated the attack – and with whom this witness specified that her friend had only been with him for three months.

“Nothing,” she answered when the prosecutor asked her if, despite knowing her since she was eleven, the defendant did not tell her about the day of the fatal beating.
