A judge summons comedian Héctor de Miguel to declare as a defendant for joking about dynamiting the Valley of the Fallen

The Court of Instruction number 38 of Madrid has summoned declare as defendant by an alleged hate crime next December 11th comedian Héctor de Miguelalso known as Quequé.

The summons occurs after being a complaint by Christian Lawyers against the comedian admitted for a crime of provocation to discrimination, hatred and violence (recovered in article 510.1 of the Penal Code). Héctor de Miguel joked on his radio show Twenty-Peak Hour with dynamiting the Valley of the Fallen—renamed Cuelgamuros—and stoning pedophile priests.

The conflict has lasted for two years. Héctor Miguel’s joke dates back to June 2022when the comedian, in an evident tone of humor, said: “Enough of pretending that this is beautiful, dammit. The Valley of the Fallen is fucking shit. Why don’t we go in there with dynamite and blow everything up. You can being a façade, but is it really pretty?”

For Christian Lawyers, these words constitute incitement to hatred. The ultra association then filed a complaint in addition to requesting the cancellation of the space through a collection of signatures among his supporters. Its objective was never fulfilled and the program is still on the air.

Following the Christian Lawyers campaign, the comedian used the microphones to counterattack and ask his followers for a list of signatures in order to demand that the fundamentalist organization “eat his ass and balls.” Also in a sarcastic attitude, he issued a warning to listeners not to call the association’s phone number, while showing it on the screen during the broadcast. This grounds, for the complaining party, a crime of harassment.

In the judicial order by which he is summoned, it is stated that Hector De Miguel there had to be appeared in court to transfer the complaint on October 16However, despite having called him by phone and proving that the first summons had been delivered to him, he finally did not appear.

“Having not appeared today the defendant Héctor de Miguel Martín (cited in legal form), for the purposes that were agreed upon (transfer of complaint and request), it is agreed to summon him, through the National Police (Unit Attached to the Investigative Courts of Madrid), for these purposes on October 30, 2024 at 10:30 a.m.”, indicates said resolution, to which EFE has had access.

For the president of Christian Lawyers, Poland Spanishthere is no doubt that the comedian committed the reported crime because that is what it would look like if he had joked about “filling mosques, synagogues, the headquarters of certain political parties, “LGBTI associations…” with dynamite.”

“It is outrageous and intolerable. Justice has to act. It is not the first time that this presenter has made similar statements, and he cannot go unpunished because these attacks against Catholics are becoming more and more,” laments the representative of this far-right association.
