The judge of the National Court Santiago Pedraz has dismissed the complaint filed by the PP against the PSOE and several defendants in the so-called Koldo caseconsidering that there is not enough evidence to admit it for processing for alleged irregular financing.
The PP based its complaint on information published in the press, which echoed the testimony of an unidentified businessman. In his ruling, the magistrate recalls that “a piece of news by itself does not legitimize any popular actor to convert the journalistic story into a story of punishable acts triggering criminal proceedings. Something more is needed.”
The complaint was directed, among others, against the PSOE, the businessman Víctor de Aldama, and Koldo García – former advisor of the former socialist minister José Luis Ábalos –, for alleged crimes of illegal financing, money laundering, influence peddling and bribery.
This document was presented before the court of Santiago Pedraz in the framework of a confidential investigation that this judicial headquarters leads on a alleged VAT fraud exceeding 182 million euros in the hydrocarbon sector.
The PP based its complaint on an article published on October 10 by The Objectivein which two anonymous informants stated that in October 2020 they took 90,000 euros in cash to the socialist headquarters of Ferraz in two deliveries inside plastic bags.
According to the testimonies, the purpose was that, through the intermediation of De Aldama and Koldo García, the Villafuel company would obtain the title of operator in the hydrocarbon sector, which it achieved.
The PP considers that the alleged delivery of 90,000 euros in cash to obtain an administrative license at a party headquarters is sufficient evidence to open an investigation to clarify who received the money and what its destination was.
In addition, the possible connection with the “Koldo case” is pointed out, investigated in the Central Court of Instruction Number 2 by Ismael Moreno, suggesting the possible involvement of an authorized person, in reference to Ábalos, which could elevate the case to the Supreme Court.
