The teacher accused of sexual assault on minors is provisionally released as there are no signs of criminality

The judge on duty of Mislata (Valencia), responsible for First Instance and Instruction 4, has decreed this afternoon, in accordance with the criteria of the Public Prosecutor’s Office, provisional release without precautionary measures for the teacher detained after being reported for a crime of alleged aggression sexual assault on seven students whose ages are around 4 years old, after not finding in the urgent investigation procedures carried out before and after his arrest “any indication of criminality founded against him.”

As explained by the Superior Court of Justice of the Valencian Community (TSJCV), the judge has taken into account in adopting this decision the result of the urgent examination of three of the children carried out by specialists from the Institute of Legal Medicine of Valencia, which does not reveal “any indication of criminality” nor has there been any evidence of any situation related to any abuse or to any of the investigated facts that have been reported by the parents, consisting of touching, kisses and intimate photographs.

The judge has also analyzed the manifestations of the work and family environment of the detainee and the initial results of the home searches and the examination of his electronic devices and his mobile phone, “which have not produced any incriminating evidence against him at this procedural moment.” ”, points out the Valencian high court.

For all these reasons, the instructor has decreed freedom and has decided to refer the proceedings to the Dean of the Courts of First Instance and Investigation of Mislata so that they can be distributed and assigned to one of its judicial bodies as they involve events of an undetermined date.
