Ciudad Juarez.- Jessica Nicole B., accused of commission by omission of the crime of negligent homicide committed against her 12-month-old son, was released on parole and must sign in monthly while her criminal case is resolved.
The request for a change of precautionary measures was made through the private lawyer representing her, who alleged that when preventive detention was ordered, it was done ex officio because, in that first hearing, it was an accusation of wilful homicide, which was not upheld for the linkage to the process, because although a formal investigation was initiated, it was done for the crime of negligent homicide against her and her partner, although with different degrees of participation: while Ever Antonio MR was classified as the author, Jessica Nicole was accused of improper omission.
According to the indictment, between 11:00 p.m. on August 13 of this year and 11:00 a.m. on the 14th, the child was attacked with a blunt object or by rapid movements that ultimately caused his death from a subdural hematoma following a blow to the head resulting from battered child syndrome.
Additional information from the Prosecutor’s Office indicates that the death was reported on August 14 at around 1:30 p.m. after Ever Antonio reported to his family that his baby was drowning.
During the initial hearing on August 22, in which the linkage to the proceedings of Jessica and Ever Antonio was resolved, the accused testified before the Court. She said that she worked in Santa Teresa, New Mexico, while her husband took care of their two children, little E. and a girl who was not identified.
Jessica got up at 5:32 in the morning, got ready to go to work while Ever prepared chicharrón burritos to sell at his job in the United States, and left. She arrived in that city at 8:00 in the evening, but, she said, around 1:10 pm she saw missed calls from her husband, and when she called him she heard him nervous. “The child is not responding,” he told her, and she left everything to return to Juárez.
When she arrived, her son was already in the pharmacy where he had been taken for treatment, but she was not able to see him until after they told her that he was dead and there was nothing more that could be done for him. (Diego Villa)
