Mexico City— By drafting and approving the opinion on the reform of the Judicial Branch, the Constitutional Affairs Committee of the Chamber of Deputies violated the Constitution, according to Judge Reynaldo Manuel Reyes, who will file an appeal against the initiative.
The argument of the magistrate, president of the Tenth Criminal Court in Mexico City, is that this ruling could only be analyzed in an ordinary session period.
He said he will appeal to a district judge in administrative matters.
“The accusation is that it lacks constitutional competence, the Constitution is being violated, which says: ‘it is the Permanent Constituent and it is made up of the Federal Congress’, which we do not yet have.
“They are moving forward, they are already linking, deputies have already issued opinions on resolutions, I don’t know who they are and I don’t know if they will be in the next Congress because their terms end on August 31. Their actions are unconstitutional,” he said.
He warned that it is worrying that the Constitutional Affairs Committee, headed by Morena member Juan Ramiro Roble, has informed the Assembly of the Chamber of Deputies that it not only analyzed the reform, but also approved a ruling.
“This Constitutional Affairs Commission lacks constitutional powers. It cannot issue any opinion, any agreement, any resolution, it cannot issue anything that binds the next Constituent Assembly that does not yet exist.
“That is to say, they are ahead of the curve. What is worrying is that it is addressed to the Constituent Assembly and in two days, three days… this has already been approved,” warned Judge Reyes.
