The aim of the new rules set for speed cameras is to make the use of speed detectors more transparent and above all fairerto try to eliminate the so-called “ATM speed cameras” installed by the Municipalities more to make money than to guarantee road safety, focusing their importance on the most sensitive sections and in critical areas for road safety such as the vicinity of schools and hospitals, etc. The “speed camera decree”introduced by the minister Matteo Salvini, makes some significant changes to the regulation of speed cameras in Italy, with the aim of improving road safety and reducing abuse. Speed cameras 2024, new regulation
- Restrictions on the use of speed cameras:
- From 2024, speed cameras will not be able to be installed on urban roads with speed limits lower than 50 km/h, unless immediate objection by the police is foreseen.
- On extra-urban roads, from 2024 speed cameras will only be able to be used if the speed limit is reduced by no more than 20km/h compared to the standard limit for that type of road. For example, on a main extra-urban road with a speed limit of 110 km/h, the speed camera can only be used if the limit is at least 90 km/h. You can’t place a speed camera on a 110km/h highway on a short stretch where there is a 70km/h limit.
- Immediate complaint:
- For speeds below 50 km/h, only immediate notification via mobile devices will be possible. If it is not possible to place visible fixed or mobile stations, devices may be used on board moving vehicles.
- Coordination and management:
- The location of speed cameras will be decided by the prefects and no longer by the municipalities, limiting their installation to stretches of road recognized as having a high accident rate or where it is difficult to make immediate complaints.
- Reporting obligations:
- Speed limits will have to be posted at least one kilometer before the speed camera station, a measure that was already foreseen but which is now reiterated.
- Device approval:
- The issue of the approval of speed cameras has not been resolved, which has generated legal disputes. The Court of Cassation recently established that fines issued by non-approved devices can be appealed, an aspect that the decree does not directly address, leaving open the possibility of appeals for fines already issued.
Authorization to install speed cameras
The installation of speed cameras outside urban centers will require the authorization of Prefect, motivated by a high rate of accidents and danger in the area. This measure aims to prevent the use of speed cameras for profit by avoiding their placement in strategic points without any real danger or significant history of accidents.
Speed cameras prohibited under 50 km/h
A significant change is the ban on installation fixed speed cameras in areas with speed limits lower than 50 km/hto avoid unfair sanctions. In any case, the decree allows the installation of mobile stations even in urban centers with limits lower than 50 km/h, such as Bologna.
Minimum speed camera distance
The decree establishes new rules for minimum distances between the signs indicating the speed limit and speed cameras: at least 200 meters on urban roads, 75 meters on other urban roads, and 1 km on extra-urban roads. These measures aim to ensure adequate signaling to motorists and reduce unexpected sanctions.
Consecutive fines for speed cameras
If a motorist is fined by multiple speed cameras within an hour on the same stretch of road managed by a single entity, will have to pay a single fine, the most severe one. This measure aims to avoid the overlap of sanctions in short intervals of time, making fines fairer.
Speed camera approval
Speed camera devices must be approved, as many currently are not, making many fines illegal. Municipalities and Provinces will have 12 months to uninstall non-compliant speed cameras. The investigation costs must be documentable and include only the costs of identifying the offender in public databases, excluding costs for equipment, legal assistance or credit recovery.
The equipment can be acquired in leasing, fixed-rate rental, loaned by public bodies or road concessionaires, without the cost depending on the amount of fines assessed or collected. The management of the equipment will always be reserved for police forceswhile private individuals will be entrusted with minor activities such as printing documents and enveloping reports.
Let’s say that this Decree is important as it sets limits especially for municipal administrations on the use of speed cameras, given that they have always installed speed cameras too easily with the main objective of making money and restoring the budgets of municipal administrations, harassing motorists rather that guarantee an improvement in road safety.
