The Abu Dhabi Family, Civil and Administrative Claims Court ruled to oblige a company to pay a worker an amount of 5,000 dirhams in compensation for procrastination in completing the contract with him, after sending him the job offer and obtaining his signature.
In detail, a man filed a lawsuit against a commercial company, demanding that it pay him an amount of 30 thousand dirhams in compensation for the procrastination, delay, and wasting of his time, in addition to the other damages it caused, indicating that he received a job offer from the defendant company with a basic salary of 2000 dirhams, for a total of 3500 dirhams, as he contacted her to complete the contract and residency procedures, but she procrastinated and delayed doing so, which caused him loss of earnings and failure to implement the contract. He attached as a basis for his claim scans of the job offer by e-mail, and a copy of the messages that took place between him. He indicated to the company via the social networking site “WhatsApp”, in addition to a copy of a job offer letter that he would start working with them immediately after signing.
For its part, the court explained in the merits of its ruling that, according to Article (112) of the Civil Transactions Law, “evidence to prove the right is: writing, testimony, evidence, inspection, experience, acknowledgment, or oath,” noting that the plaintiff showed through the papers, The defendant was wrong, as conversations with her representative indicated that she asked him to sign the contract and he did so, as stated in her subsequent response that the documents had been submitted to obtain residency, and from the follow-up and sequence of letters.
The court added that the lawsuit papers showed the plaintiff’s entry into the country on a visit visa, and the defendant (the company) did not change his status, pointing out the absence of the defendant’s representative from the sessions and to raise any plea or defense in the lawsuit, thus proving her mistake in procrastinating and not completing the procedures or He was unable to do so, which led to his being harmed by loss of earnings and procrastination in completing the contract and issuing a residence permit for him. The court ruled to oblige the defendant to pay the plaintiff an amount of 5,000 dirhams, comprehensive compensation, while obliging her to pay fees and expenses.
