The defendants were charged with armed criminal association, qualified damage, attempted coup d'état, among other things.
The STF (Supreme Federal Court) already has a majority to convict another 29 defendants for the acts of January 8, 2023, when the headquarters of the Three Powers were invaded and vandalized, in Brasília. The rapporteur, minister Alexandre de Moraes, voted for the application of sentences ranging from 14 to 17 years in prison.
He was accompanied by ministers Gilmar Mendes, Dias Toffoli, Cármen Lúcia and Luiz Fux. Magistrates Cristiano Zanin and Edson Fachin voted for conviction, but with reservations regarding the defendants' sentences. Ministers Luís Roberto Barroso, president of the Court, André Mendonça and Nunes Marques disagreed with the rapporteur. Voting takes place in the virtual plenary, in which ministers have a period to vote remotely, without in-person deliberation.
The ministers had until 11:59 pm on Monday (Feb 5, 2024) to inform the vote. The session began on December 15, 2023. Each case is judged individually, that is, the penalties will only be known at the end of the process due to differences between the ministers.
All defendants were charged by the PGR (Attorney General's Office) for the crimes of armed criminal association, qualified damage, attempted coup d'état, violent abolition of the Democratic Rule of Law and deterioration of listed property.
To date, this is the largest set of criminal actions judged simultaneously.
Last Friday (Feb 2), the Court began the trial, also virtually, of 12 defendants for the same crimes. Rapporteur Alexandre de Moraes voted for conviction. The session ends on February 9th.
