The Superior Electoral Court (TSE) is expected to approve a resolution this year to regulate the use of artificial intelligence during October's municipal elections. The date for voting on the resolution has not yet been defined, but the rules will be discussed at a public hearing that will be held by the court at the end of this month.
The TSE intends to guarantee the prohibition of the manipulation of voices and images with content known to be untrue to disseminate disinformation against the fairness of the elections and negative propaganda against candidates and parties on social networks and in electoral propaganda.

The objective is to prevent the circulation of montages of images and voices produced by artificial intelligence applications to manipulate false statements by candidates and authorities involved in organizing the election.
According to the draft resolution released by the court, the platforms will be responsible for removing untrue content originating from artificial intelligence. After being notified, providers must take measures to remove the material from the internet and carry out due investigation of those responsible for publishing it. Platforms should also be prohibited from boosting posts with misinformation.
According to the initial rules, content manipulation may be punished with a sentence of two months to one year in prison, in addition to payment of a fine.
The TSE also wants to guarantee checking agencies that sign cooperation agreements with the court the power to classify content as false, true or out of context.
The public hearing on the topic will be held between January 23rd and 25th and will be led by Minister Cármen Lúcia, who will preside over the TSE during the municipal elections in October. In the election, mayors, vice-mayors and councilors will be elected.
