According to the testimony of María Sotelo, the minor's mother, her daughter only bit off half of the candy. However, the candy was so sticky that blocked the airway of the girl, so she had to be immediately taken to a medical center for emergencies.
Upon arrival, the doctors had to use a special machine to remove the gum, which resulted in a somewhat delayed procedure that caused the minor to suffer a serious lack of oxygen. This triggered permanent brain damage and spastic quadriplegia.

The event was recorded by Francisco Paredes Rivera and María Aylin Sotelo Camacho, parents of the minor. In the video you can see the parents running towards their three-year-old daughter, Amelie, as she began to choke.

The family filed a lawsuit on December 28 in Philadelphia, United States, against Frankford Candy & Chocolate Co., Frankford Candy LLC and Hasbro, alleging that the candies under the name 'Candy Land Gummy Dots' they don't come with enough warnings.
The court documents state that the sweets that the minor consumed were made “in a manner and mixture that makes them unreasonably dangerousdue to its extreme stickiness and its inability to be properly broken down by the introduction of human saliva,” according to ABC News 4.

Therefore, the family accuses the companies of failure to warn, negligence, negligent infliction of emotional distress, among other aspects.
“Those sweets were a time bomb. We will search justice for this innocent girl who was once a vibrant and prosperous girlbut is now permanently disabled, unable to speak, swallow and move, for the rest of her life,” said Thomas Bosworth, attorney for the minor's family.
