In detail, a car rental company filed a lawsuit against a young man in which it demanded that he be obliged to pay it an amount of 54 thousand and 240 dirhams, and to pay the plaintiff an amount of 2000 dirhams in compensation for the damages she suffered, while obliging him to pay interest at the rate of 5% from the date of his refusal to pay, in addition to Obligating him to pay fees, expenses, and attorney fees, noting that the defendant rented a vehicle from them and did not pay the rest of the rent and the violations committed on the vehicle.
For its part, the court explained in the merits of its ruling that what is established, through the lease contract concluded between the two parties, is that the defendant rented the vehicle from the plaintiff for a daily fee of 300 dirhams, and it remained in his possession for 295 days, based on the date of its return stated in the lease contract, while it was not The defendant shall appear to present any plea or defense in the case, or prove that he has paid the value of the fees or traffic violations he owes.
The court indicated that the value of the rent, according to what was agreed upon by the two parties, amounted to 88 thousand and 500 dirhams, and it was found that the defendant paid the amount of 36 thousand and 660 dirhams, so that the remaining amount due was 51 thousand and 840 dirhams, which was not proven to be paid to the plaintiff, while it was found that the vehicle was rented at the time Committing 6 violations worth 2,400 dirhams, and that the plaintiff is obligated to pay the value of those violations, as he is the owner of the vehicle and responsible for the violations that result from it during the period of his possession, so that the total value resulting from the vehicle rental contract is 54 thousand and 240 dirhams.
Regarding the request for compensation, the court indicated that what is established is that the defendant did not pay the amount of the rent and traffic violations, which proves the element of error in the contractual liability and its connection to the damage inflicted on the plaintiff by not benefiting from her entitlements from the time they became due until the date, which entitles the plaintiff to demand her compensation, and the court ruled to oblige the plaintiff He must pay the plaintiff the amount of 54 thousand and 240 dirhams, and the late interest thereon at the rate of 5% annually from the due date until full payment, not to exceed the principal of the debt, and oblige the defendant to pay compensation to the plaintiff in the amount of 500 dirhams, for the damages she suffered, and oblige the defendant to pay expenses. The lawsuit, and all other requests were rejected.
