While the young man denied his association with the plaintiff with any commercial business, and denied his preoccupation with any amounts, explaining that his brother had entered into the car trade business with the plaintiff, and the trade was lost and the plaintiff refused to bear the loss, and that he intervened between them to make a settlement and sent a WhatsApp message to the plaintiff, asking him to attend. To a lawyer’s office to make a settlement in the amount of 19,000 dirhams, but his brother refused and confirmed that he was not entitled to the amount, because he received profits from trade that exceeded the capital he paid.
The plaintiff stated that he had partnered with the young man’s brother in a car trade, and that he owed his brother 26,000 dirhams, and after his brother was released from custody, the young man guaranteed the payment of 19,000 dirhams, which is the amount that was settled between them.
The court stated in the merits of the ruling that it was established from the papers that the settlement concluded before the law firm was between the plaintiff and the young man’s brother, and the young man was a mediator in those settlements, and no pledge or commitment was issued from him regarding the payment of those amounts, and then the young man negates his status in the lawsuit. And the case is also necessary for the judiciary to reject the case against him, and the court ruled to reject the case.
