A woman who insulted and harassed a Muslim woman was sentenced to six months jail and a penalty fee of thousand 80 euros (equivalent to 25 thousand 700 pesos) in Santander. The offender hurled insults at the victim when she was walking through the streets of The Sardinero with hijab, as the Islamic veil is called. For this reason, the Criminal Judge number four issued the sentence for a hate crime.
The aggressor, a 71-year-old resident of Santander, will not step in jail – according to the agreement reached – unless she commits a new crime within two years.
The reduction of the sentence was given after the Santander woman recognized the facts, because the penalties initially requested by the ministry public were nine months in jail and a fine of 2 mill 400 euros (56,650 pesos).

However, it was decided that the defendant compensates the victim, a resident of Oviedo, with 900 euros (21,230 pesos) for the moral damage caused by these events, which occurred in the summer of 2019.
This is the amount claimed by the private prosecution – the public one asked for 500 -, exercised by the Muslim woman and legally represented by the lawyer Mario García-Oliva, who also requested a year in jail and a fine of 3,600 euros. “Either you take off that scarf that you wear on your head or you leave“.
His client, who lives in the Asturian capital, was vacationing in Santander on the weekend when everything happened. It was around 5:45 p.m. local time on June 30, 2019, when the victim -daughter of Syrian citizens exiled to Spain and settled in Oviedo, where he has his domicile – he walked through the Plaza de Italia, in The Sardinero, which was quite busy.
I was with him hijab in the head, in accordance with the precepts of his religion, and pushing the stroller of his nephew, aged 14 months, when the defendant addressed her with the following offenses: “Luckily he is a child, otherwise you would have put that shitty scarf on “; “go to your country”; “Either you take off that scarf you wear on your head or you leave”; and “shit moors.”
Subsequently, the defendant approached three young people who were sitting on a nearby bench and making gestures such as putting on a handkerchief, he told them: “Those Moors come here and they want us to invade and impose the veil on us, and we cannot allow it“,” if you shut up, in a few years they will force you to cover yourselves. “
