O TSE (Superior Electoral Court) ordered the removal of false publications involving the presidential candidate Luiz Inacio Lula da Silva (EN). One concerns the alleged audio in which the former president would have said: “Nobody had the competence and courage to take this guy down. [Antônio Palocci]”.
According to the petition presented by the Brasil da Esperança Federation, the content was disseminated on social networks in 2017 and, at the time, denied by checking agencies. The audio, however, was once again shared on the internet in profiles such as that of the deputy Eduardo Bolsonaro (PL-SP) and singer Roger Moreira. Here’s the intact of the action (54 KB).
In his decision, published this Monday (26.Sep.2022), Minister Paulo de Tarso Vieira Sanseverino determined that Twitter, Facebook, Youtube, TikTok Kwai, Gettr, SoundCloud and Google suspend, within 24 hours, the disclosure of the audio attributed to Lula. Failure to comply may result in a fine of R$10,000.
“In fact, it is inferred from the initial and the evidence attached to it – notably from the several analyzes made by the scrutiny agencies – that the contested propaganda disseminates disinformation by using an imitation of the voice of the candidate Lula, to attribute an aggressive reaction to the alleged testimony given by Antônio Palocci“, says the magistrate.
Sanseverino also opened the possibility of manifestation of those represented in the action, among them Eduardo Bolsonaro and the singer Roger Rocha Moreira.
NURSES FLOOR
In another action, signed on Sunday (September 25), Minister Cármen Lúcia ordered publications that attribute false statements to former President Lula to be taken down. According to the representation filed by the Brasil da Esperança Federation, the candidate would have said that “nurses only serve serve soup“. read the intact of the decision (48 KB).
The declaration would have taken place when the STF (Federal Supreme Court) suspended the nursing salary floor. The group argues that the publication tries to spread the idea that Lula would be against remuneration for the category.
Among the suspended content is a video of a live made by the deputy and candidate for reelection Colonel Thaddeus (PL-SP) on Youtube and Facebook, in which the congressman credits the phrase about nurses to Lula.
“The posts on the social networks of those represented present content produced to misinform, as the message transmitted, as demonstrated in the initial and confirmed by the checking and press agencies, has no support in reality.“, says the magistrate.
