The Turin Court of Appeal accepted the appeal of the chief prosecutor of Verbania Olimpia Bossi against the order of the Gip Donatella Banci Buonamici who had released two of the three arrested in the aftermath of the tragedy of the Mottarone cable car, Enrico Perocchio And Luigi Nerini. From the testimonies of the employees – the investigating judge had written in the order rejected today by the review court – “the strongly accusatory content against Tadini is evident”, because “all unanimously declared that the decision to keep the stocks was his, while no one spoke of the manager or the service manager ”. And these statements “deny” Tadini’s “correct call” against Nerini and Perocchio. “Tadini – wrote the investigating judge – knew very well that he had made the decision not to remove the logs, he knew perfectly well that his wicked act had caused the death of 14 people, and he knew that he would have been called to respond also and above all in civil terms of the disaster caused.
And then – continues the judge – why not share this immense weight, even economic, with the only two people who would have had the opportunity to claim damages? Why not also attribute to Nerini and Perocchio a decision not to remove the stocks? ” “Tadini – added the investigating judge – knew very well that by calling the strong subjects of the group together, his profile of responsibility, if not excluded, would have been attenuated. The judge of the preliminary investigations also expressed an assessment of the approach that the Prosecutor had taken in the first phase of the investigation. “It is clear – wrote Banci Buonamici – at the time of the request for validation of the arrest and application of the precautionary measure the total lack of clues against Nerini and Perocchio that are not mere, even suggestive suppositions” and he spoke of “meager evidence” .
A picture that in his opinion had “weakened even more” with the interrogations of guarantee that took place in the prison of Verbania. Finally, the arrest was to be canceled because there was no danger of the suspects escaping. A tranchant judgment also on the reference made by the prosecutors of Verbania to the “national and international media hype” of the Mottarone cable car accident to support the “danger of escape” of the 3 arrested.
