In recent months, TikTok has become a controversial company in the USA, given that said country is seeking a ban because another external company cannot become so relevant, since according to them they could be international spies seeking to expose their people. In fact, they have told the company that if they do not sell to someone local they must leave the region, and given this, those from China They are already planning a counterattack that includes a lawsuit.
This is one of the arguments they launched against the law that mentions that the company must already be in the hands of an American within a period of 270 days, encouraging that it is not possible if they agree. Here you can read it:
The ‘qualified disintegration’ required by law to allow TikTok to continue operating in the United States is simply not possible: not commercially, not technologically, not legally. And certainly not in the 270-day time frame required by law. The petitioners have repeatedly explained this to the US government, and the sponsors of the Act were aware that divestment is not possible. There’s no doubt about it: The law will force a shutdown of TikTok by Jan. 19, 2025, silencing the 170 million Americans who use the platform to communicate in ways that can’t be replicated elsewhere.
In the presentation, the owners of the platform, ByteDance, called the ban “unconstitutional,” and claims that such divestment would simply be impossible; According to the presentation, this would result in TikTok would cease to exist at the beginning of next year.
The petition goes on to state that even if such a thing were possible, it would still be unconstitutional. One of the reasons the US government has objected is the company’s alleged ties to the Chinese government. Congress has argued that it could be used to spy on private citizens. However, it is claimed that if the law were upheld, it would give Congress the power to circumvent the First Amendment by invoking national security, saying this could also be used against newspapers and websites.
For now, the lawsuit has already been filed before the United States Court of Appeals and we have to wait to see how it proceeds.

Author’s note: In fact, many of TikTok’s fans have demonstrated in some media for the government to leave the company alone. However, it may cease to exist in these markets.
