There is already pre-agreement in the ERE of the automotive company IT Automotive. In today’s seventh meeting, positions were approached to specify the measures to be applied in this file that will be voted this Friday by the staff.
The pre-agreement includes a reduction of those affected by the ERE in a number of 55 jobs. Thus, in direct labor, of the initial 45, 5 people who are currently in TB1/HUB are excluded, maintaining their conditions; 13 people from indirect labor and two from the structure group.
As for the impact criteriavoluntariness is established and those under 50 years of age are accepted. In addition, TI Automotive will study the cases of those people of higher age and with different criteria, reserving the acceptance of these voluntarities. Other criteria are the positions affected and the least seniority.
The pre-agreement also includes that, if accepted, the deadline for volunteer presentation before the Human Resources department by means of a document or sending an e-mail. Initially, it will be from November 22 to November 25, 2024 at 6:00 p.m. In this way, on November 26 of this year the list of conditions would be announced.
The text includes some exclusions such as situations of suspension of the contract due to birth, adoption, custody for adaptation purposes, foster care, risk or illness during pregnancy, childbirth and breastfeeding, risk during breastfeeding, pregnant workers or workers with previous permits or assumptions, or reduction of day for legal guardianship.
Also part of the exclusions are workers who are victims of gender violence or sexual violence, exercising their right to effective judicial protection or the rights recognized in the Workers’ Statute to make effective their protection or their right to social assistance. comprehensive.
Both parties have specified that the departure execution timesetting a maximum of December 20 of this year. The established 15-day notice may be financially compensated, totally or partially in its absence.
At the point of compensation it is established that it will be 33 days of salary per year workedwith a maximum limit of 14 monthly payments. To calculate the compensation, it will be done with the average of the contribution base of the last 12 months. It is fixed on 2,500 gross euros for the linear complement compensation for each worker affected by the collective dismissal.
Another of the highlights of the pre-agreement is the hiring by TI Automotive of a outplacement service for people affected by the company Lee Hetch Harrison (LHH). A job orientation and support program is included in the search for a new job for six months starting from the individual inclusion in the program.
There will also be subscribed special agreement with Social Security for employees who are 55 years old fulfilled at the time of termination of the contract and a commission will be created to monitor the measures agreed for this collective dismissal. Finally, a job board to be developed in the monitoring commission for relocations in the two Tauste plants.
From CCOO they have indicated after the pre-agreement that progress has been made in the voluntary process, although “it is not the scenario that we have opted for during the negotiation of the ERE.”
For the union, the ERTE could be a valid tool, but it considers that progress had to be made in trying to reach an agreement before the end of the ruptured consultation period.
In this sense, they point out that the pre-agreement includes some of the proposals that the committee has demanded, in addition to pointing out that “the conditions achieved are a point and continued in the face of the challenges that we have to continue assuming in future scenarios.”
