A relative of victims who died at home during the covid-19 pandemic without receiving medical assistance has filed a complaint in the Superior Prosecutor’s Office of the Community of Madridas reported this Monday by the delegation of the conference ‘Thousands of people in situations of dependency discriminated against’, promoted by the association Dignity and Justice in Nursing Homes (DJRM), in a press release in which it was mentioned that it is the first to occur due to this type of situation.
The complaint was made in the context of a meeting between the association and the senior prosecutor of the Community of Madrid, Almudena Lastrain which DJRM has informed him that it is going to initiate “a collective claim before the European Committee of Social Rights.”
“The son is the one who filed the lawsuit, after the death of his parents in March and April 2020 at their homes, without having received medical attention,”as a consequence of the application of the exclusion protocols developed by the Government of Isabel Díaz Ayuso”, president of the Community of Madrid, as expressed by the association. These protocols are known as the “protocols of shame” by the associations that demand to investigate the deaths that took place during the pandemic in the Spanish capital.
The complaint shows dozens of phone calls to Medical Emergency Service (SUMMA 112) and visits and calls to Mirasierra Health Center that the victims’ relative made to request medical assistance and an ambulance, because his father had suffered a stroke in November 2014 and was moving in a mechanical chair. He only managed, after 15 days, to have a medical professional visit the home to diagnose that his father was dying and could only apply palliative care.
The mother died in the early hours of April 12 to 13, 13 days after the father’s death. During that period, the son repeated calls to the Health Center and SUMMA 112. On April 13, a medical professional certified the mother’s death at home.
The complainant has asked the Prosecutor’s Office to proceed ex officio with the necessary steps to determine the facts indicated in the document. Furthermore, the conference delegation has informed the prosecutor that they will present “a collective claim to the European Committee of Social Rights on the basis of violation of rights included in the complaint”.
Lastra has responded that he will use the means of the Prosecutor’s Office to investigate the events reported in the complaint, and more specifically the telephone calls.
Other complaints of deceased relatives in residences
Over the last few years, several people and associations have filed complaints with the Prosecutor’s Office to investigate the deaths that occurred during the first months of the covid-19 pandemic.
The last one occurred on October 10 by the associations Residence Tide and 7291: Truth and justicewho represent more than a hundred relatives of users who died in the pandemic. That day they presented one for the “discrimination suffered” during covid-19, in which 7,291 residents They died without being taken to a hospital in the Community of Madrid.
This complaint was directed against 29 people, including “senior government officials“: the two directors of the Social and Health Coordination of the Government of Madrid during the first wave of the pandemic, Carlos Mur and Francisco Javier Martínez Peromingowho were “the signatory and author” of the protocols that prevented the transfer of residents to hospitals and against Pablo Searchdirector of SUMMA 112 at that time.
Also against Antonio Burgueñoauthor of the shock plan against the pandemic; and against the geriatricians responsible for applying the protocol in the 25 Madrid public hospitals, as specified by the spokesperson for Marea de Residencias, Carmen Lopezand the president of 7291: Truth and justice, Maria Jesus Valeroin a press conference.
The complaint was filed by 108 family members of 115 residents who lived in 72 different residences in the region and it provides “unpublished documentation” such as “internal government reports that reflected the situation in which the nursing homes were,” as López and Valero explained.
