The Prosecutor's Office has requested sentences totaling 139 years and six months in prison for five individuals accused of kidnapping another man who had met the girlfriend of one of them. Likewise, they allegedly beat him repeatedly, sexually assaulted him and recorded everything with their mobile phones, according to the indictment from the Public Ministry.
The trial is scheduled to begin on Tuesday, April 9, at 10:00 a.m., in Room 002 of the Second Section of the Provincial Court of Murcia.
The events date back to 11:00 a.m. on May 2, 2021, when the man who appears as a victim of the events appeared at the Murcia bus station looking for the girlfriend of one of the accused. After meeting, both had a conversation in which they told each other that they loved each other and decided to go together to Alicante in the vehicle owned by the former.
They traveled to Alicante and parked the vehicle on public roads, in a public parking lot located between Albufereta beach and Avenida de la Condomina.
On the afternoon of May 3, 2021, the man left to have a coffee, leaving the woman in the vehicle with his mobile phone to talk to her relatives. However, she took the opportunity to call her boyfriend and send him the location of the place where they were.
When the man returned, the woman was not there and neither was her mobile phone. At around 11:00 p.m. that same day, while the victim was in the vehicle parked in the aforementioned parking lot, the five defendants appeared.
As the prosecutor relates, the five defendants then hit the victim repeatedly with the intention of harming his physical integrity. All this, nullifying any possibility of defense due to the numerical superiority of the aggressors.
Next, in order to restrict his freedom of movement, they put him in the trunk of his own vehicle to take him to Molina de Segura and, once inside the car, they continued beating him.
The victim's vehicle was driven by the main defendant, without the consent of the owner of the car, which was in the trunk.
Once in Molina de Segura, they parked the vehicle, took the victim out of the trunk and dragged him up the stairs to the home of the main defendant.
Inside the home, they took him into a bedroom, threw him on the bed and, taking advantage of the superiority of the 5 accused, two of them grabbed his hands with a rope. Next, the main defendant sexually assaulted him repeatedly while holding a knife to his neck in an attempt to intimidate him.
Meanwhile, two other defendants carried out security duties, preventing the injured party from defending himself, grabbing him by the arms and legs at specific moments. The defendants carried a stick and knives with the intention of frightening the victim and causing him a feeling of fear and restlessness. Likewise, they insulted and threatened him.
Furthermore, with the agreement of all the accused, two of them recorded these events with their mobile phones with the aim of violating the privacy of the victim. Subsequently, they displayed these images in the place where several of the defendants worked.
Finally, the main accused sent a photo of the victim to his cousin at around 12:45 a.m. on May 4, 2021, along with the text “we have already arrived at my house” in the Bulgarian language.
The victim's cousin forwarded the photograph to another cousin of the victim, who notified the Molina de Segura Local Police. The agents appeared at the home of the main accused and released the attacked person after 1:00 a.m. on May 4, 2021.
A few days later, the main accused gave the victim's cousin the keys to the vehicle that belonged to the victim, as well as his mobile phone.
As a consequence of the above, the victim suffered various bruises, wounds and pain that required initial medical assistance, 14 days of basic injury healing and medical treatment. Likewise, she suffered post-traumatic stress syndrome, which required medical treatment and 30 days of healing for moderate damage, also leaving 6 points of sequelae.
Based on all this, the prosecutor considers that the five accused are accused of a crime of injuries for which each of them should be sentenced to three years and six months in prison. Furthermore, the Public Ministry considers that the five would be co-authors of a crime of illegal detention for which it requests five years in prison for each of them.
The five would also be perpetrators of a crime of discovery and disclosure of secrets, according to the prosecutor, who is requesting, based on this, a sentence of three years and six months in prison for each of them.
The main accused, for his part, would also be the author of a crime of sexual assault for which he requests a sentence of 15 years in prison, while the other four defendants would be necessary collaborators in this crime and it would be appropriate to impose on each of them They were sentenced to 13 years and six months in prison.
Finally, the main defendant and two other defendants would be co-authors of a crime of theft of use of a motor vehicle for which the prosecutor requests a sentence of three years and six months in prison for each of them.
