Many people have asked me if after the end of the government of President Andrés Manuel López Obrador the welfare pensions will continue to be granted or not. Our response has been conclusive in the sense that they will continue to enjoy said pension in light of the principle of progressivity of the human rightscontained in the third paragraph of article 1 of the Political constitution of the United States of Mexico, reformed since 2011, and by virtue of the fact that, in addition, the aforementioned pension is consigned as one of the human rights provided for in the fifteenth paragraph of the article 4 Of the same Supreme Law of the Union.
Based on this principle, all authorities have the duty to broaden the scope and protection of human rightswith the purpose of achieving its full effectiveness materialand not only of theoretical character.
This means, for example, that the legislator is bound to broaden the scope and protection of the human rightsthrough the legal systems that it issues and, for example, also, by the Executive, who is constrained to interpret the laws, in such a way that it expands said rights. This from the material point of view and not only as a simple entelechy.
Such a principle does not admit regressivitythat is, the human rights They should not go backwards, but on the contrary, forward. In such a way that it is not even possible for the legislator juridically issue laws that go against the same ones that were already established in the Constitution and which also appear in the International deals in which our country is part.
The Executive, for its part, is not allowed to see said human rights as simple programmatic objectivesand unless they are conditioned to the existence budgetary or of certain public politics of a nature six-yearbut that they must be fully satisfied, regardless of the political ups and downsunder the pretext of certain specific circumstances that the country is experiencing at a certain time.
in such a way that the state authorities have the obligation to take concrete measures, aimed at satisfying the human rights; One of them being the pension for the elderly, which, we reiterate, was established in the Constitutionand it is the case article 1 establishes that all the country’s authorities, within the scope of their powers, are obliged to protect, guarantee, to promote Y respect the aforementioned rights.
So Adults over the age of sixty-five and over who are registered in the now Welfare Secretariat should not worry or worry when the time comes for the government headed by Andrés Manuel López Obrador to leave.. And it is suggested that they not see said pension as a gift, but as a right protected human by the aforementioned principle of progressivity established in the Constitution.
Finally, it is good to say that the exercise of said right does not oblige them to vote for this or that political party nor candidate, since they have full freedom to exercise their diverse right to vote.
