The Government Chamber of the Superior Court of Justice (TSJ) has closed the door to the Ministry of Justice, which intended to carry out next Tuesday an act of presentation of the second phase of the City of Justice of Murcia, in operation since 2012 This body, chaired by Javier Luis Parra, unanimously agreed to prevent this act, which is expected to be chaired by the Secretary of State for Justice, Tontxu Rodríguez, and which, he explains in a file, has been called unilaterally. The TSJ asks the General Council of the Judiciary (CGPJ) for protection against what it considers “undue interference.”
This unusual situation began this Thursday when the Government Chamber of the TSJ met in extraordinary session after receiving the invitation from the Ministry to the aforementioned act on Wednesday. The representatives of this body found out about the event, apparently, through an email sent from the Protocol department of the cabinet of the Minister of Justice to different authorities.
The TSJ, in its agreement, to which LA VERDAD has had access, stresses the importance of preserving the neutrality of judicial venues. This circumstance, he remarks, “requires that no executive body, nor any of its positions, can use a judicial venue on its own and exclusive initiative for any activity that is not strictly judicial.” This, in any case, notes the Chamber, must have been “communicated, assessed and, where appropriate, expressly authorized” by this body.

In its letter, the Government Chamber explains that it does not know “the scope of what is intended to be ‘presented'” and stresses that “a sort of inauguration/presentation of phase II of the City of Justice, which is in operation, would not be acceptable operational since 2012 (eleven years ago)”. Nor would it be, he remarks, “the presentation of projects or investments by a body of the national Executive, which would find their reasonable location in other dependencies outside the headquarters of courts and tribunals.”

This body emphasizes that “the unilaterality of the initiative and call for said act by the Ministry of Justice deviates from the usual uses of coordination, cooperation and inter-institutional loyalty that the Government Chamber deems should be preserved.” With these arguments, the Government Chamber of the TSJ agreed to prevent this act and send a notice to the Ministry. It also alerted the CGPJ to what it considers “undue interference in powers inherent to the self-government statute of the Judiciary.”
