The Consistory will not have to pay 4.5 million euros for the occupation of the Rambla de los Aznares for the construction of hundreds of houses
The Supreme Court exonerates the City Council of Mazarrón from responsibility for the occupation of the Rambla de Los Aznares. This is the decision of the high court after a long litigation process began in 2014. The Council of Ministers then ratified a sanction proposed by the Segura Hydrographic Confederation (CHS) against the Consistory, worth 4.5 million euros, for the urbanization works of hundreds of villas in Camposol. Municipal sources explain that “the Contentious-Administrative Chamber in its Fifth Section, estimates the appeal filed by the Mazarrón City Council”, thus annulling that central government agreement and condemning the CHS for costs.
The events originated from the occupation of hydraulic public domain assets on the Rambla de los Aznares. According to the mayor, Gaspar Miras, the Consistory began to ask the CHS in 2003 for reports on the works that were being carried out in the aforementioned urbanization. “Now, the Supreme Court understands that there is no municipal responsibility in these works and that the custody function belongs to the CHS,” explains the socialist alderman.
Miras is pleased because “the City Council will no longer have to pay the 4.5 million euros of the fine.” Instead, he assures that the high court “did see responsibility on the part of the promoter (Justo and Manoli)”. The first mayor maintains that “we have saved our good work in this procedure, because it is quite clear that we never had any kind of responsibility in the construction of the hundreds of houses in Camposol.”
The ruling emphasizes that “the Rambla de los Aznares seems to not even have been known by the CHS until the Mazarrón City Council itself requested a report, in relation to the Project for the Modification of the Action Program, prepared as a result of the irregularities detected by the technical services of municipal inspection, who appreciated the modifications in the urbanization process not foreseen in the Partial Plan». Specifically, the municipal technical architect warned that the works carried out did not coincide with those proposed in the project.
