He Supreme Court has given definitive closure of the investigation against the former Catalan president Carles Puigdemont and the ERC deputy Ruben Wagensberg by a crime of terrorism for his role on the platform Democratic Tsunami who organized the protests against the ‘procés’ ruling.
In an order, the criminal chamber of the Supreme Court dismisses the appeals that presented the accusations exercised by Societat Civil Catalana, Vox and the Dignity and Justice association and confirms the decision of the investigating judge to archive the Tsunami case, after the proceedings carried out were declared null and void in recent months due to a procedural error.
The magistrate closed the case once the judge Manuel García-Castellón filed the case of the National Court in which ten people were investigated, including the general secretary of ERC, Marta Roviraafter the decision of the criminal court of declare the invalidity of the proceedings in this case from July 29, 2021.
In accordance with the criteria of the Prosecutor’s Office, the Supreme Court rejects the arguments of the accusations, which argued in their appeals that there were indications to maintain the accusation of Puigdemont and Wagensberg, wielding for this the order of February 2024 in which the high court agreed to investigate them for terrorism.
Nevertheless, The court remembers that in that order the court only declared itself competent to investigate the casewithout this implying the start of the investigation, which must be concluded as of July 29, 2021.
In this sense, the Court recalls that, since then, there has been no practice “no investigative diligence” in relation to Puigdemont and Wagensberg that allows the case to be kept open against them.
