The Senate slows the Lobato maneuver and warns that it is incompatible to keep the seat and return to its job

Just one day after the regional congress of his party in Madrid and the enthronement of Óscar López as the new leader of the Madrid socialists, Juan Lobato has tried to move. The still deputy in the assembly and senator by regional designation has been unmarked this Monday with an announcement that has surprised among his own ranks. In social networks he communicated his intention to return to his job as an official at the Tax Agency and maintain the minutes in the upper house, although without receiving the salary. A maneuver that is not remembered precedents and that has no viso to prosper.

According to sources from the Senate presidency consulted by eldiario.es, neither of the two proposals of Lobato conform to the regulation. That is, nor can you give up your salary as a senator while occupying a seat, nor can you access a job as a public official because the law sets it as incompatible.

This is explicitly expressed in article 157 of the Organic Law of the General Electoral Regime (Loreg) states that “the status of deputy and senator is incompatible with the exercise of public function”, and reserves compatibilities for other cases, such as for example university teaching.

Neither in the PSOE, nor in the Óscar López team in Madrid they wanted to rule on it and have indicated that it is the Senate who must respond to the request of former Secretary General of Madrid. His request to return to his position in the Tax Agency would have to go through the Commission of Incompatibilities of the Senate, which after declaring the incompatibility would give him “eight calendar days to opt between the seat and the position incompatible”, according to article 17 of the article 17 of the Upper House Regulations. But, according to sources from the Presidency, said request, made public this morning by Lobato, had not been, however, registered in the afternoon.

Lobato, who was forced to resign after admitting that he brought before a notary a private conversation with his party partner, Pilar Sánchez Acera, about the alleged fiscal fraud of Isabel Díaz Ayuso’s couple, decided to keep her seats both in the assembly of Madrid and In the Senate, where one of the seats destined for autonomous designation occupies.

The law also sets that it cannot charge at the same time the remuneration as a parliamentarian of both cameras and, therefore, chose that of the Senate, which is more large. Although the Assembly has continued to receive a “compensation of non -exclusivity” that reaches 1,271 euros monthly gross, as reflected in its payroll, as in that of other senators by regional designation, which are available on the website of the Parliament Madrid, according to EFE.
