BRASÍLIA (Reuters) – The rapporteur of the PEC dos Precatórios and leader of the government in the Senate, Fernando Bezerra (MDB-PE), announced on Tuesday that he will promote six changes in the text of the Proposed Amendment to the Constitution (PEC), including the definition of Auxílio Brasil as a permanent social program worth 400 reais.
According to the senator, a determination will also be incorporated so that the fiscal space of more than 100 billion reais to be opened if the PEC is approved will be linked to the payment of aid, social security expenses and constitutional minimums for education and health.
“Within the analysis that the government is carrying out, being able to meet new demands, we will do so, because we want to build the broadest possible text”, said the leader, without discarding new alterations to the text.
Bezerra admitted, however, that there are “limitations” in these negotiations. One of them concerns the discussion of the sub-ceiling for precatório, a topic that the government does not want to address. Another point that the Executive does not give up is the change in the deadline for correction of the spending ceiling, which will be synchronized with that of mandatory expenses.
The proposal will be analyzed by the House’s Committee on Constitution and Justice (CCJ) on Wednesday and by the plenary of the Senate next week, where, by the senator’s calculations, it can obtain between 51 and 53 votes, just above the 49 needed for the approval of a change in the Constitution.
The government leader also expressed the expectation of enactment this year, in order to make it possible to pay the aid before Christmas.
If modified in the Senate, as proposed by the rapporteur, the PEC would have to go through a new vote in the Chamber, or it could have points of consensus between the two Houses promulgated separately. The senator preferred not to go into details about the possibility of the second hypothesis.
Considered a priority by the government for allowing the opening of a fiscal space of more than 100 billion reais, the PEC modifies the rules for payment of court orders, government debts whose payment was determined by the Court and changes the deadline for correction of the spending ceiling by the IPCA.
The proposal intends to give the Executive room to put Brazil Aid into practice to replace Bolsa Família. Added to temporary benefits, the new social program will offer 400 reais to low-income families by the end of 2022, the year in which President Jair Bolsonaro is expected to seek re-election.
The prospect of disrespecting the spending ceiling and what opposition parliamentarians usually call a “default” in the payment of court orders, however, provoked resistance in the Senate.
