According to data from the TSJ, the courts received 3,259 divorce petitions and 163 separation petitions
The courts of the Region registered 3,422 applications for marital dissolution in 2021, 1.12% more than in 2020. Specifically, 163 separation applications and 3,259 divorce applications were filed, according to data collected by the Statistics Service of the General Council of the Judiciary made public this Monday
Registered separations grew by 22.56% compared to 2020. However, the number of divorce applications hardly changed. In 2021 no claim for nullity was registered. Taking into account the existence of an agreement between the parties in the matrimonial dissolution procedures, a growth of 4% can be seen in the consensual ones compared to a decrease of 2.35% in the contentious ones.
Relating the demands for dissolution of marriage for the total for the year with the population as of January 1, 2021, it can be verified that the highest number of demands for dissolution per 100,000 inhabitants occurred in the Canary Islands, with 247.5; the Valencian Community, with 238.8; Balearic Islands, with 229.7; Region of Murcia, 225.4; Andalusia, 218.8; Cantabria, 213.7; and Catalonia, 208.3. All these autonomous communities exceeded the national average, which stood at 205.7 demands for dissolution per 100,000 inhabitants. On the contrary, the territories where a lower number of lawsuits were filed were Castilla y León, with 162.3; Basque Country, with 170.1; and Comunidad Foral de Navarra, with 180.8.
In 2021, a total of 3,422 demands to modify measures were filed in the Region. Of these, 418 consensual marriages, 16.8% more than the previous year; and 1,032 requests for modification of non-consensual matrimonial measures, 14.2% more than in 2019. The requests for modification of guardianship, custody and support of non-marital children agreed, which totaled 731, fell by 4.19% compared to the year previous; while those not agreed upon (1,071), experienced an increase of 4.7%.
During 2021, the number of parents who decided to go to a consensual procedure when proposing a modification of measures regarding their minor children grew by 2.50%. Although most of these procedures, 65% of those registered, remain contentious.
