Pedro Rocha will no longer be able to preside over the Royal Spanish Football Federation (RFEF). His last cartridge went through the National Court and it has rejected it. The Contentious-Administrative Chamber has rejected his request to provisionally suspend the two-year disqualification imposed on him by the Sports Administrative Court (TAD) for exceeding his duties when he presided over the management of the federal entity.
The Chamber considers justified the disqualification of the Extremaduran for “acting arbitrarily, substituting the will of the federative entity for his own and subtracting from the governing body the exercise of powers that corresponded exclusively to it.”
The order adds that “it is possible to think that if the precautionary measure is agreed upon and the interested party continues in the position of president of the RFEF, there is a real risk that these behaviors could be repeated with the consequent serious injury to the legal rights that the disciplinary regulations address. to protect.”
Given this, he emphasizes that the “general interest” must prevail, which translates into “the correct functioning of sports institutions”, something that would collide with someone exercising the presidency who carried out “conducts that represent a serious attack on these.” values, to the extent that they collide with impartiality and respect for the rules.”
With this court decision, Rocha will not be able to stand for election to the presidency of the RFEF. This refusal by the National Court adds to the two previous occasions in which other judicial instances also denied him the possibility of provisionally suspending the disqualification.
It is worth remembering that the man from Extremadura was disqualified last July when justice was considered to have exceeded his duties as president of the RFEF Management Commission with the decision to fire the previous general secretary, Andreu Camps.
Rocha could present an appeal before the Supreme Court within a month, but this resolution would already go beyond the electoral calendar planned by the federation.
Applications can be submitted starting tomorrow and the last day of the deadline will be December 3. The body made this modification to the calendar precisely this Wednesday. What remains unchanged is the date of the elections, which will be December 16. At the moment, only the economist Juanma Morales has made official his intention to be a candidate to lead the RFEF, but to do so he will need 21 endorsements, something that seems complex.
