Judge Manuel García-Castellón, an instructor at the National Court, has dismissed Repsol and Caixabank for the Villarejo case, as well as the current president of the oil company, Antonio Brufau; and the former president of the bank and former vice president of the energy company, Isidro Fainé. According to an order to which EL PAÍS has had access, the magistrate has made this decision after questioning this week the legal representatives of both companies, who denied any irregularity on their part in the hiring of Cenyt, the business group headed by the commissioner retired José Manuel Villarejo, despite the suspicions of the investigators that the two companies took over the services of the police to plot an espionage operation in 2011 against Luis del Rivero, then president of Sacyr and that he wanted to take control of the oil company after a pact with the Mexican Pemex.
During the statements this week, the representatives of Repsol and Caixabank defended that the company only contacted Cenyt to legally obtain any information about the agreement between Pemex and Sacyr, but never to collect personal data that could imply a violation of rights – in the records to Villarejo, a record of telephone calls from the alleged victims was found. In addition, they stressed that the hiring was transparent and rigorous, and the internal standards and control of the companies were always complied with.
Until now, Judge García-Castellón also held several executives of both companies accused of these events. Among them, Antonio Brufau, current president of Repsol; and Isidro Fainé, former president of CaixaBank and former vice president of the Spanish oil company, for whom he files the investigations. Both have already denied the judge any illegality and insisted that they did not know who Villarejo was. The retired commissioner baptized this alleged espionage operation against Del Rivero as Project Wine and, according to the summary, collected at least 400,000 euros from both companies.
