It is noted that the attackers were charged under Part 3 of Art. 30, pp. “A, c, g” part 2 of Art. 105 of the Criminal Code of the Russian Federation (“Attempted murder committed by a group of persons by prior conspiracy against two or more persons, including a minor”). As Maksimov recalled, they are punishable by up to life imprisonment. However, in this particular case, the maximum measure may be 15 years’ imprisonment.
In addition, it is a mitigating circumstance that not all participants in the fight have reached the age of majority. Since the attempt was not brought to murder, they face a maximum of 7.5 years in prison. The lawyer added that all the circumstances of the incident will be established during the investigation. If it is proved that the accused did not seek to kill the child and his father, then the case may be re-qualified. Then the punishment should be less severe, he stressed.
On November 4, in the Novye Vatutinki area, a man with a child was attacked. Law enforcement agencies opened a criminal case. The Moscow headquarters of the Ministry of Internal Affairs said that the attackers were employed as laborers. They received Russian citizenship nine years ago.
All four participants in the attack in New Moscow were arrested. The defendants in the criminal case refused to plead guilty to the attempted murder, but do not deny participation in the fight. The defense said they would appeal the arrest.
